Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and BarkShare LLC("BarkShare," "we," "us," or "our"). They govern your use of https://www.barkshare.dog and the BarkShare mobile app (together, the "Services"). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to create an account or use account features. By using the app, you represent that you are 18+, that your information is accurate, and that you are not barred from using the Services under applicable law.

3. What BarkShare is (and is not)

BarkShare is a social platform that helps dog owners and dog lovers connect, join packs, plan meetups/events, chat, and share a dog-focused feed. BarkShare is free at launch.

BarkShare is not a veterinarian, trainer, boarding kennel, paid pet-sitting marketplace, insurer, or employer of users. We do not provide pet-care services. We do not supervise offline meetups. You are solely responsible for decisions about your dogs and interactions with other people and animals.

4. Accounts

You are responsible for your account and for keeping login credentials secure. You must provide a valid email and phone number for verification where required. Do not share your account, create fake profiles, or impersonate others. Notify us promptly of unauthorized access.

5. Acceptable use

You agree not to:

  • Post harmful, abusive, misleading, illegal, or infringing content;
  • Harass, threaten, stalk, or intimidate others;
  • Misrepresent yourself, your dogs, vaccinations, or temperament;
  • Spam, scrape, or disrupt the Services;
  • Circumvent security, moderation, or access controls;
  • Use BarkShare for commercial solicitation without our prior written consent;
  • Use the Services for any unlawful purpose.

6. Zero tolerance for objectionable content and abusive users

BarkShare has zero tolerance for objectionable content or abusive behavior. Do not post content that is offensive, harmful, harassing, sexually explicit, hateful, threatening, or otherwise objectionable, and do not harass or abuse other users. We review reported content and will remove objectionable content and/or eject the responsible user within 24 hours of a report when practicable.

7. Child safety standards (CSAE)

BarkShare has zero tolerance for child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM). The Services are for adults only (18+). We prohibit any content, messaging, profiles, or behavior that exploits, endangers, sexualizes, or otherwise harms minors.

If we obtain actual knowledge of CSAM on BarkShare, we will remove it promptly, preserve records as required by law, suspend or terminate the responsible account, and report to NCMEC CyberTipline and/or other authorities as required.

8. Your content

You retain ownership of content you post. You grant BarkShare a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting/delivery), display, and distribute your content solely to operate, improve, promote, and secure the Services. That includes showing your content to other users according to your privacy and audience settings, and using content you make publicly available on BarkShare (such as public feed posts or public profile photos) in BarkShare's own marketing about the community. We do not claim ownership of your content. This license ends when your content is deleted from our systems, except for reasonable residual copies in backups or caches that expire in the normal cycle, or content others have lawfully reshared.

You represent that you have all rights needed to post your content (including photos of people and dogs) and that it does not violate law or others' rights. Photo posts may be reviewed before appearing in public feeds.

9. Safety, meetups, and assumption of risk

BarkShare helps people connect online. Offline interactions — including meetups, walks, playdates, events, packing dogs together, entering homes, or exchanging care — are solely between you and other users (and your respective animals). We do not screen users beyond limited verification and moderation tools, do not guarantee anyone's identity, temperament, vaccination status, or skill with dogs, and do not supervise offline activity.

Meet safely: meet in public places first; trust your judgment; never feel pressured to share your address or home access; use block/report tools.

Assumption of risk: You understand that interacting with other people and dogs involves inherent risks, including injury, illness, property damage, escape, bites, and emotional distress. You voluntarily assume those risks to the fullest extent permitted by law.

Release: To the maximum extent permitted by law, you release BarkShare LLC and its officers, employees, and agents from claims and damages arising out of or related to offline interactions with other users or animals, user-generated content, or reliance on information provided by other users — except to the extent caused by our willful misconduct where such limitation is not allowed.

10. Reporting and enforcement

Use in-app block and report tools for users, posts, packs, or messages that violate these Terms. We may investigate and suspend or terminate accounts, remove content, or limit features at our discretion.

11. Intellectual property / DMCA

BarkShare branding, software, and site materials are owned by us or our licensors. You may not copy or reuse them without permission, except as needed to use the Services.

If you believe content on BarkShare infringes your copyright, email support@barkshare.dog with subject "DMCA" and include: your contact info, description of the work, URL or location of the material, a statement of good-faith belief, a statement under penalty of perjury that you are authorized to act, and your signature (physical or electronic). We may remove content and, in appropriate cases, terminate repeat infringers.

12. Website use

You may browse the website for personal, non-commercial purposes. Do not misuse the site, attempt to disrupt it, scrape it without permission, or submit false information through forms. Cookies and analytics are described in the Privacy Policy.

13. Termination

You may delete your account anytime in Settings. We may suspend or terminate access if you violate these Terms or if needed to protect the Services or other users. Data handling after deletion is described in the Privacy Policy. Sections that by nature should survive (including licenses for residual copies, disclaimers, limitation of liability, indemnity, and governing law) survive termination.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free service, accuracy of user content, or the conduct of any user or animal.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARKSHARE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR INTERACTIONS WITH OTHER USERS OR ANIMALS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

16. Indemnity

You agree to defend and indemnify BarkShare LLC and its officers, employees, and agents against claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, your offline conduct (including involving dogs), or your violation of these Terms or others' rights.

17. Governing law

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Exclusive venue for disputes that are not resolved informally is the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise. You and BarkShare LLC consent to personal jurisdiction there.

18. Changes

We may update these Terms by posting a new version on this page. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services and delete your account.

19. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and BarkShare LLC regarding the Services and supersede prior agreements on that subject.

Severability. If any provision is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, corporate reorganization, or sale of assets.

Notices. We may provide notices via the Services, email, or by posting on barkshare.dog. You may send legal notices to support@barkshare.dog.
